Waiver

Waiver of Liability and Negligence Clause
In consideration of the Yukon Sourdough Rendezvous Society, its sponsors and agents (the Society) allowing me to participate in and or volunteer for activities or events organized by the Society, and for other good and valuable considerations, hereby agrees to the conditions as follows:
1. The individual is aware that the participation in any Society event will be exposed to certain risks and dangers inherent with sports and festivals. These risks and dangers include but are not limited to extreme weather conditions, extreme physical exertion, faulty equipment, airborne objects, moving vehicles, dogs, or other animals not leashed or out of control as people under the influence of drugs or alcohol. The individual accepts these risks and dangers.
2. The individual releases from all liability and agrees not to pursue legal action against the Society, its directors, volunteers, sponsors, agents, and representatives for any personal injury, death property damage, or loss sustained as a result of, or during participation in any Society event howsoever caused including without limitation, negligence on the part of the Society, its directors, officers, employees, volunteers, sponsors, agents and representatives.
3. The individual waives all claims they may now and in future have against the Society, its directors, volunteers, sponsors, agents, and representatives.
4. The individual hereby agrees to indemnify the Society for any claim loss or action made against the Society by a third party arising out of or as a result of the actions or inactions of the individual in a Society event or activity.

-The individual herby authorizes the Society, its directors, volunteers, sponsors, agents, and representatives to carry out the inspection or impoundment of equipment to ensure safety or compliance with the rules of the Society, The individual also hereby waives, releases and indemnifies those authorized to do such inspections or compliance sanctioned for any loss or claim resulting from them carrying out their responsibilities.

-The individuals at his/her expense shall purchase sufficient insurance to protect himself/herself, his/her team or party and the Society, its directors, volunteers, sponsors, agents and representatives from any loss, claim, or demand whatsoever made while participating or assisting in any activity or event of the Society.

-The individual acknowledges and agrees that the Society, its directors, volunteers, sponsors, agents, and representatives have exclusive right to use, sell and transfer the individual name, photographs, images, statements , personal information and all related data and materials to the media and other related sources with or without monetary or other consideration to be paid by the Society, and the individual waives any rights or claim to compensation for the use, sale, or transfer of the individuals name, photographs, images, statements, personal information and all related data and materials.

-The individual further releases all rights to images obtained during their involvement in any society event or activity for purposes of marketing the Society, its sponsors agents and representatives. Images include drawings, photographs, video clips and any version of the before mentioned items. The Society also reserves the right to alter such images.

-The individual acknowledges and agrees that this consent, release, waiver and indemnification shall be binding upon parties named herein and their respective heirs, executors, administrators, successors, and assigns.

-The Society reserves the right to refuse participation or involvement due to intoxication.

-Intending to be legally bound the Volunteer / Participant confirms that he/she has read this document and fully understands its contents. The Volunteer / Participant understands that by approving this document they are giving up certain legal rights including the right to sue the Society.

-It is also understood that the Volunteer / Participant is sixteen (16) year of age or older. If the individual is eighteen (18) years of age or under, a parent or legal guardian must also read and sign this document.

-All volunteers may be required to submit a personally signed copy of the waiver at time of volunteering

Rendezvous Covid Vaccine Policy
The safety, health, and well-being of those who work, volunteer and visit Yukon Rendezvous remain our first and highest priority. The COVID-19 virus continues to be a risk in the workplace. As a result, we are adopting a Mandatory COVID-19 Vaccination Policy to ensure the health and safety of our Employees, Volunteers, Independent Service Providers, and guests, and to complement existing protocols and prevention measures.

SCOPE
This Policy applies to all Yukon Rendezvous and Yukon Sourdough Rendezvous Society Employees, Volunteers, Independent Service Providers, who will be obligated to comply with this Policy to protect themselves, other employees and the public in the workplace.

DEFINITIONS
Employee: Means all full-time, part-time, seasonal, temporary, and casual (on-call) employees of Yukon Rendezvous and Yukon Sourdough Rendezvous Society.
Volunteer: Means an individual who is registered as part of Yukon Rendezvous and Yukon Sourdough Rendezvous Societies volunteer program.
Independent Service Provider: Refers to an individual person or group that provides services or entertainment to our guests in event areas and our property and/or leased and rented space.
Yukon Rendezvous Team Members: Refers to all employees, volunteers and independent service providers “employed” by Yukon Rendezvous and Yukon Sourdough Rendezvous Society.
Proof of (COVID-19) Vaccination Status: Defined as being fully vaccinated with COVID-19 vaccines that are approved by Health Canada by January 30th 2022 and receiving one vaccine dose by November 30th 2022. This may also extend to booster doses if doses are required by public health.

POLICY
1. Requirement to provide proof of vaccination:
All Yukon Rendezvous and Yukon Sourdough Rendezvous Societies Employees, Volunteers, Independent Service Providers must provide proof of vaccination against COVID-19 as of December 17, 2021.
Yukon Rendezvous Team Members actively employed, and not at that time fully vaccinated, have until 11:59pm on December 17, 2021 to provide their proof of vaccination.
2. Proof of Vaccination:
All Yukon Rendezvous and Yukon Sourdough Rendezvous Society Team Members must provide proof of vaccination as followed:
(i) Yukon Rendezvous and Yukon Sourdough Rendezvous Society Team Members currently employed must provide proof of first covid 19 vaccine dose no later than December 17, 2021.
(ii) Yukon Rendezvous and Yukon Sourdough Rendezvous Society’ Team Members currently employed must provide proof of full vaccination no later than 11:59pm on January 30, 2022;
(iii) Yukon Rendezvous and Yukon Sourdough Rendezvous Society Team Members who are hired but have not started work at that time are expected to follow the same timeline outlined above as a condition of remaining employed; and
(iv) Yukon Rendezvous and Yukon Sourdough Rendezvous Society Team Members who are hired after December 17, 2021 must provide proof of Vaccination prior to employment and as a condition of becoming employed or volunteering.
3. Administration:
Employees, Volunteers, Independent Service Providers must provide:
- Proof of Vaccination: must complete the enclosed COVID-19 disclosure form (“COVID-19 Vaccine Disclosure and Acknowledgement Form”), and send a copy, along with their proof of vaccination status to Executive Director at covid@yukonrendezvous.com by December 17, 2021; or
- Exemption: must complete the enclosed COVID-19 disclosure form (“COVID-19 Vaccine Disclosure and Acknowledgement Form”) to provide their rationale and send it to Executive Director at covid@yukonrendezvous.com no later than December 17, 2021. Further supporting documentations will be required no later than 11:59pm December 17, 2021. Proof may be through their vaccine card or through an approved Yukon Government Health Gateway vaccine QR code, or similar government-issued document if out of Territory/Province/ Country. Providing false or misleading information may result in discipline up to and including termination.
4. Compliance
Failure to provide proof of full vaccination or a recognized validation of an exemption by 11:59pm on November 30, 2021 will result in a temporary layoff, effective December 18, 2021. Employees will be recalled the sooner of: [a] the employee becoming full vaccinated; and [b] Yukon Rendezvous and/or Yukon Sourdough Rendezvous Society rescinding this policy. Job offers are contingent on compliance with this policy and incoming Yukon Sourdough Team Members who do not comply will have their job offer and/or service contracts rescinded.
5. Policy Modification
This Policy will comply with all applicable laws and may be amended from time to time. Government and public health guidelines and restrictions, as well as business and industry best practices regarding COVID-19 and COVID-19 vaccines are changing rapidly as new information becomes available and further research is conducted. Yukon Rendezvous and Yukon Sourdough Rendezvous Society reserves the right to modify this policy at any time in its sole discretion.

REASONABLE ACCOMMODATION
Yukon Rendezvous and Yukon Sourdough Rendezvous Society provides reasonable accommodations, absent undue hardship, to employees with a valid medical or religious reason that prevents them from taking a vaccine. For clarity, accommodations will not be made for employees who choose for personal reasons not to be vaccinated. Employees, volunteers, or independent service providers requesting an accommodation under this section should do so through the COVID-19 Vaccine Disclosure and Acknowledgement Form. All requests will be forwarded to the Executive Director for consideration. Exemptions based on medical or religious grounds will require written validation from a licensed physician or leader of a recognized religious group on official letterhead. This should be uploaded when completing the vaccination status form. Professional fees incurred for physician letters may be expensed with receipts.

USE OF INFORMATION, CONFIDENTIALITY AND PRIVACY
Yukon Rendezvous and Yukon Sourdough Rendezvous Society will keep an employee’s vaccination status and exemption documentation confidential from third parties in accordance with applicable privacy laws. When submitted, documentation will be stored within a secure database with restricted access and not constitute part of the employee file. It will be destroyed once the information is no longer required or when the policy is no longer in effect, whichever is the sooner. Yukon Rendezvous and Yukon Sourdough Rendezvous Society will never disclose vaccination status without the written consent of the employee. Yukon Rendezvous and Yukon Sourdough Rendezvous Society may also publicly disclose the existence of this Policy.

CONTINUED APPLICABILITY OF OTHER POLICIES
This policy is designed for use together with, and not as a substitute for, other COVID-19 prevention measures. All employees must continue to use personal protective equipment and abide by the COVID-19 Policy, whether they have been vaccinated against COVID-19 or not. This includes complying with infection prevention practices, such as handwashing and sanitizing, wearing a mask, completing daily health checks, and staying away from the workplace and informing management if they experience any symptoms related to COVID-19, or receive a positive test result.
